Should the Constitutional Court be reformed?

" Should the Constitutional Court be reformed?" was the title of the excellent program presented by Thomas Hugues and co-hosted by Mathieu Croissandeau "Le Sens Public" on Public Sénat on May 10, 2023. Also taking part in the debate were Lauréline Fontaine, Professor of Law, and Frédéric Potier, of the Fondation Jean Jaurès, RATP's General Delegate for Ethics and Compliance.

Despite the complexity of the subject, in my opinion the moderation of the debate made it possible to clarify many points, in particular the so-called politicization of the institution. When we talk of "politicization" of an institution, it's often because its decisions are unpalatable, and we must therefore cast doubt on the impartiality of the body that made them. As Bertrand Mathieu rightly pointed out, no constitutional or supreme court is a perfect model. The French court, the Constitutional Court, has certain particularities linked to its history, as it was not envisaged as a true court when it was created in 1958. TheConstitutional Court has metamorphosed into a full-fledged court in successive stages, as its jurisprudence and constitutional revisions have evolved. It will continue to evolve, and that will be good, but what it has become today is already a remarkable success, at least in my eyes.
